Who are Dreamers?
The term “Dreamer” refers to individuals who were taken to the United States as children by their parents, other relatives or even as unaccompanied minors, and grew up without legal immigration status, in that country
What is DACA?
The Deferred Action for Childhood Arrivals (DACA), is a program that provides legal protections and work authorization to immigrants who otherwise lack legal status but were brought to the U.S. as children through no fault of their own. In place since 2012, DACA currently protects around 495,300 Dreamers
DACA recipients are entitled to the following:
- Temporary protection from deportation
- Work authorization
- Allow recipients to study and work while remaining in a legally precarious situation.
Who qualifies for DACA?
- Have been born on or after June 16,1981
- Have come to the United States before the age of 16
- Have continuously resided in the US since June 15,2007 up to the time of filling for DACA
- Be enrolled in school, have graduated, obtained a GED, or served in the military
- Have no serious criminal convictions
Why are the challenges for many dreamers ?
- DACA is not a law passed by Congress
- It is an administrative policy
- It does not lead to permanent residence or citizenship
- Dreamers remain dependent on a program that can be changed or revoked
- For more than two decades, proposals such as the DREAM Act have been introduced to provide Dreamers with permanent status nothing have passed
- Immigration reform remains deeply polarized, leaving Dreamers in prolonged legal limbo
- DACA has faced multiple legal challenges
- This ongoing litigation creates uncertainty about whether protections could be reduced or eliminated in the future
- Many Dreamers entered the U.S. without inspection, which severely limits their ability to adjust status through family or employment sponsorship
- In many cases, leaving the U.S. could trigger long re-entry bans, making legal pathways extremely restrictive
- Dreamers are students, professionals, entrepreneurs, and essential workers who contribute significantly to society, yet lack long-term security
- Without congressional action, there is no permanent solution under current U.S. law.
